Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to Survey the land and fix boundary stones in respect of Punja Survey Nos.266/2B and 266/4B having an total extent of 0.06.50 hectares properties situated at Mudiyanoor Village, Kallakurichi Taluk and Kallakurichi District on the basis of the petitioner's application dated 10.05.2023 within a reasonable time that may be fixed by this Court.

O R D E R

The petitioner herein seeks a direction to the respondents to Survey the land and fix boundary stones in respect of Punja Survey Nos.266/2B and 266/4B having an total extent of 0.06.50 hectares properties situated at Mudiyanoor Village, Kallakurichi Taluk and Kallakurichi District, by considering the petitioner's application dated 10.05.2023 within a time fixed by this Court.

According to the petitioner, he is the absolute owner of the land in Punja Survey Nos.266/2B and 266/4B having total extent of 0.06.50 hectares situated at Mudiyanoor Village, Kallakurichi Taluk, Kallakurichi District, and patta No.1196 was issued in his favour in respect of the said properties. The petitioner made an application dated 10.05.2023 along with required fee, to the second respondent seeking to survey and measure the above mentioned properties and fix the boundaries stones. However, the said application has not been considered till date. Therefore, the petitioner is before this Court.

3. Mr.P.Sathish, learned Additional Government Pleader, who takes notice for the respondents would submit that the application of the petitioner would be considered on its own merits and appropriate orders will be passed.

In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the second respondent to consider the application filed by the petitioner dated 10.05.2023 and pass final orders, after issuing notice to all the interested parties, within a period of six weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs.
