4/2021 on the file of the respondent Police within a period of four weeks from the date of receipt of a copy of this order, without prejudice to his defense before the trial Court and on such deposit being made, the concerned Magistrate, after obtaining undertaking from the Mattur TANGEDCO, Krishnagiri, rep. by the defacto complainant herein, that if the petitioner succeeds in the case, the said amount would be refunded back to him, shall disburse the amount to the Elecrricity Department. The concerned Magistrate Shall accept the sureties furnished by the petitioner on such deposit being made and proof filed by the petitioner; imposed in CRL.O.P.No.13686 of 2021 dated 05.08.2021. [IN CRL.M.P.No.14137 of 2021] (ii) Extent the Time to execute the order in Crl.O.P.No.13686 of 2021 dated 05.08.
2021 to pass such futher or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice. Vide order dated 05.08.2021 this Court had enlarged the petitioner on anticipatory bail on certain conditions. This petition has been filed by the petitioner seeking modification of the conditions and for extension of time to comply with the said conditions.
2. Learned Government Advocate (Crl.Side) appearing for the respondents, on instruction, strongly opposed these petitions, as the petitioner on his own volition only accepted to deposit the amount, while granting anticipatory bail.
3. As rightly pointed out by the learned Government Advocate (Crl.Side), while granting anticipatory bail, the petitioner on his own volition, came forward to deposit the amount. Now he could not get back from his stand and seek modification of the said condition.
4. In view of the above, the petition in CRL. M.P. NO. 14137 OF 2021, stands dismissed. However, the time is extended by two weeks to deposit the amount as undertaken by the petitioner, while grant of anticipatory bail to him and thereby the petition in CRL. M.P. NO. 14139 OF 2021, is ordered.
