The petitioner herein was arrested on 16.02.2025 in Crime No.6 of 2025 for the alleged offence under Sections 363, 366, 366(A), 328, 376(2)(n), 376(D), 354(C) of IPC, Sections 5(g), 5(i), 5(I) r/w 6(1) of the Protection of Children from 1/4

Sexual Offences Act, 2012 and Sections 8(c), 27(A) of NDPS Act, in Crime No.6 of 2025, registered on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner herein was reprimanded because the minor girl had been penetrated and had sexual intercourse with her and had also taken lewd photographs of the victim girl and circulated them among his friends. He was arrested on 16.02.2025 and remanded to judicial custody.

3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and the allegations made against him are absolutely false. He further submitted that he did not administer any drugs to the victim girl to exploit her sexually and neither did he introduce her to others.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submits that the statement of the victim girl clearly indicated the involvement of this petitioner and the other accused. He opposed for the grant of bail to the petitioner, stating that this petitioner deceived the victim girl and exploited her sexually under the pretext of love. He further submitted that it is a case of gang rape and one of the accused is still absconding.

5. Considering the nature of the complaint, this Court is of the view that granting bail to this petitioner at this juncture, who is a perpetrator of the crime, will derail the process of the trial. Hence, this Criminal Original Petition stands 2/4

dismissed.
