PRAYER : Criminal Appeal has been filed under Section 378(4) of Criminal Procedure Code, and under Section 419 of Bharatiya Nagarik Surakhsa Sanhita,(BNSS), 2023, to set aside the acquittal Judgment passed by the Principal Sessions Judge, Erode in C.A.No.206 of 2022 dated 28.06.2024, and reversing the order passed in S.T.C.No.110 of 2019, dated 30.09.2022 on the file of the Judicial Magistrate, Fast Track Court No.1, Erode. JUDGMENT

This Criminal Appeal has been filed by the complainant, against the judgment passed in C.A.No.206 of 2022 on the file of the learned Principal Sessions Judge, Erode, and thereby acquitting the respondent from the charges for the offence punishable under Section 138 of the Negotiable Instruments (NI), Act, 1881, reversing the judgment of conviction and sentence rendered in STC.No.110 of 2019 dated 30.09.2022 by the learned Judicial Magistrate Fast Track Court, Erode.

2. Heard both sides and perused the materials available on record.

3. Upon perusal of the records, it is seen that while the appeal was pending, on the request made by the appellant and the respondent, this appeal was referred to the Tamil Nadu Mediation and Conciliation Center attached to this Court, wherein, the dispute between the parties was settled between the parties by way of a Joint Memo of Compromise dated 29.04.2025 and the cheque amount is also reported to have been settlled as part of the mediation.

4. In view of the settlement between the parties and Joint Memo of Compromise dated 29.04.2025, entered thereupon, before the Tamilnadu Mediation and Conciliation Center attached to this Court, nothing survives in

this appeal.
