Respondents Prayer:-Criminal Original Petition is filed under Section 482 Cr.P.C., to direct the fifth respondent to provide police protection to the petitioner and to his family members from the threat of the accused those who are involved in the offences in F.I.R.No.3542 of 2015 dated 16.11.2015. O R D E R
The petitioner has come forward with this petition seeking a direction to the fifth respondent to provide police protection to the petitioner and his family members.
2.Learned counsel for the petitioner submits that on the basis of the complaint given by the petitioner, a case in Crime No.3542 of 2015 has been registered for the offences under Sections 341, 342, 364(A), 384, 365, 506(ii) IPC read with 120B IPC against the proposed accused. The proposed accused were arrested and subsequently, granted bail. Therefore, the petitioner out of fear, has given the representations to the respondents on 07.03.2016 and 09.03.2016 seeking police protection to him and his family members. Since the respondents have not taken any steps, the petitioner has come forward with this petition for the above stated relief.
3.Learned Additional Public Prosecutor submits that the petitioner has been examined and his representations are under the process.
4.Considering the rival submissions made on both sides, the fifth respondent is directed to consider the representations given by the petitioner dated 07.03.2016 and 09.03.2016 and pass appropriate orders on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.
5. The Criminal Original Petition is disposed of with the above direction.
