This petition has been filed to condone the delay of 37 days in filing the above Second Appeal.

2. The learned counsel for the petitioners would submit that the first respondent had deliberately refused to receive the notice and hence, it has been returned as refused.

3. Considering the above fact and the averments stated in the affidavit filed in support of the petition, the delay is condoned.

Accordingly, this petition is ordered.
