PRAYER: Criminal Miscellaneous Petition has been filed under Section 528 of BNS Act, to modify the conditions that the 1st petitioner shall deposit original title deeds of documents of immovable property worth of Rs.20 lakhs at the time of furnishing sureties and instead of the 1st petitioner has not any properties in his name and 1st petitioner has all those properties in his wife's name alone and 1st petitioner's wife shall deposit the original title deeds of the immovable property worth of Rs.20 lakhs in Crl.O.P.No.17644 of 2025 dated 27.06.2025.

ORDER
This petition has been filed seeking to modify the conditions that "the 1st petitioner shall deposit original title deeds of documents of immovable property worth of Rs.20 lakhs at the time of furnishing sureties" and instead of the 1st petitioner has not any properties in his name and 1st petitioner has all those properties in his wife's name alone and 1st petitioner's wife shall deposit the original title deeds of the immovable property worth of Rs.20 lakhs in Crl.O.P.No.17644 of 2025 dated 27.06.2025.
2. The 1st petitioner was earlier granted anticipatory bail by this Court in Crl.O.P.No.11579 of 2023 dated 14.06.2023 that the 1st petitioner is ready to deposit original title deeds of documents of immovable property worth Rs.20 lakhs at the time of furnishing the sureties. Thereafter, the petitioners filed an extension petition seeking some more time. Finally, that also elapsed, and again the petitioners filed Crl.O.P.No.17644 of 2025, and this Court by order dated 27.06.2025, had granted anticipatory bail to the Page No.2 of 4
petitioners that, "the 1st petitioner shall deposit original title deeds of documents of immovable property worth of Rs.20 lakhs at the time of furnishing sureties"

Learned counsel for the petitioners submitted that the 1st petitioner does not hold any property of such value, and his wife, N.Malarkodi, has three properties in Doc.No.431 of 2002, Doc.No.2846 of 2013 and Doc.Nos.2847 of 2013 on the file of SRO Kallakurichi. He further submitted that as per the document, the value of the properties is lesser, but the market value of three properties will be more than Rs.20 lakhs.
4. Heard both sides and perused the materials available on record.

Considering the facts and circumstances of the case, this Court directs the Trial Court to accept these three documents along with an affidavit of N.Malarkodi giving an undertaking that the property will not be alienated or encumbered in any manner, and she will also pay one of the sureties in this case.
