Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the second respondent to classify the Survey Nos.372/5, 373/4 measuring about 0.19.50 hectare situated at the Devarmukkulam Village, Karadhihalli Revenue Taluk, Kaveripattinam (PustheethiPaathai) in the A-Register as per entry made in FMB Sketch and to direct the respondent to remove the encroachment made in the same by the fifth respondent. ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.S.Nagarajan, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader for the respondents 1 to 4.

2. Learned counsel for the petitioner submits that the lands in S.Nos.372/5 and 373/4, situated at Devarmukkulam Village are classified as public pathway in the A-Register. It is stated that the fifth respondent has encroached upon the public pathway.

3. Learned State Government Pleader submits that S.Nos.372/5 and 373/4 are patta lands, issued in favour of the fifth respondent.

4. In case the petitioner is aggrieved by the issuance of patta, then the petitioner may take steps as provided under the provisions of the Tamil Nadu Patta Passbook Act, 1983.

5. With these observations, the writ petition stands disposed of. There will be no order as to costs.
