O R D E R
(Order of the Court was made by The Hon'ble Chief Justice) The writ petition is a reflection of the inaction on the part of the respondent authorities at every level. At the initial level, the hoarding was permitted to be installed without obtaining the requisite permission of the Corporation in terms of the license given. It was the intervention of the Court which resulted in the hoarding being taken down. Now, when the petitioner has filed an application on 08.09.2016 for No Objection Certificate, for one and a half month, there is no decision on it.
2. The aforesaid position is completely unacceptable. There is no reason why people are compelled to come to this Court and spend money on account of such inaction of the authorities. The learned counsel for the second respondent states that the application of the petitioner would be decided promptly now.
3. We, thus, direct the application dated 08.09.2016 to be decided within a period of fifteen days from today and impose costs on respondent No.2 for the inaction, quantified at Rs.3,000/- (Rupees Three Thousand only) to be recovered from the Officer, who sat over the file. The order to be brought to the notice of the second respondent/Commissioner.
