O R D E R
The prayer sought for in the Writ Petition is to issue directions to the respondents to declare probation of the petitioner in the post of B.T. Assistant (Maths) with all service benefits including the annual increments and other attendant benefits.
2.By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.The learned counsel for the petitioner would submit that without completing the eligible test, the probation of the petitioner has to be declared for which the Joint Director of School Education sent a proceedings dated Nil-12-2017 bearing e/f/vz;/063080-rp3-,2-2017 to the Chief Educational Officer of 16 districts. However, till date the Chief Educational Officers did not pass any order. Hence, this Court may issue a direction to the third respondent to comply the order dated Nil-12-2017 bearing e/f/vz;/063080-rp3-,2-2017 within a reasonable time. 4.The learned Special Government Pleader appearing for the respondents submitted that the petitioner is not a qualified person and she has not completed the T.E.T. test. Hence she is not entitled to declaration of probation.
Further this Court may issue a direction to the second respondent, the Chief Educational Officer, Dharmapuri District to pass appropriate orders on the proceedings dated Nil-12-2017 bearing e/f/vz;/063080rp3-,2-2017 within a reasonable time. 5.Considering the facts and circumstances of the case and the limited request made by the learned counsel for the petitioner, I am inclined to issue direction to the third respondent to pass appropriate orders on the proceedings dated Nil-12-2017 bearing e/f/vz;/063080-rp3-,2-2017 in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
6.With the above direction, the Writ Petition is disposed of. No costs.
