M.Murugesan v. Inspector Of Police

2023-10-04Honourable Mr Justice C.V. Karthikeyan2 pages

Crl.O.P.No.25041 of 2022 Crl.O.P.No.25041 of 2022 and Crl.M.P.No.16138 of 2022 C.V.KARTHIKEYAN, J.

It appears that a settlement has been arrived at between the defacto complainant and the accused and copy of the said settlement agreement has been filed into the Court which is dated 21.02.2023. I am not able to understand as to why the petition is still pending, when the parties have registered the said agreement.

2. Let the respondent-police issue notice under Section 41-A of I.P.C to both the de-facto complainant as well as the accused, thereafter examine the nature of the complaint, nature of the settlement and then let the Investigation Officer take decision about the First Information Report which has been registered.

2. In view of the fact that the petitioner had entered into an agreement anticipatory bail is granted to the petitioner, however he should appear whenever the notice is issued under Section 41-A and any further enquiry before the respondent-police.

3. Accordingly, this Criminal Original Petition is closed. Consequently, connected Crl.M.P is closed.
