This revision has been filed as against the order passed in Crl.M.P.No.856/2025 dated 29.04.2025 by the Judicial Magistrate No.II, Mayiladuthurai, thereby dismissed the petition to return the passport.

The petitioner is an accused in Crime No.13 of 2022 registered for the offence punishable under Sections 406, 419, 420, 465, 468 and 471 of IPC and thereby, he cheated the de-facto complainant to the tune of Rs.2,12,72,500/-. That apart, he also involved in three other cases out of which in one case, he was convicted and he did not appear and as such non-bailable warrant was issued against him. Subsequently, a Look Out Circular was also issued and when the petitioner reached the Airport at Trichy, he was arrested and remanded to judicial custody. That apart, the petitioner has changed his name into several names and committed the offences. Further, the investigation is still pending in Crime No.13 of 2022 and as such, the trial Court had rightly dismissed the petition for return of passport. Hence, this Court finds no infirmity or illegality in the order passed by the trial Court. 2/4

3. Accordingly, this Civil Revision Case is dismissed. However, the respondent is directed to complete the investigation and file a final report within a period of four weeks from the date of receipt of a copy of this order. Thereafter, if any change of circumstances, the petitioner is at liberty to file a petition to return the passport, in the manner known to law.
