O R D E R

The petitioner has come forward with this petition seeking for a direction, directing the respondent to conduct fresh / de novo investigation on the complaint given by the petitioner dated 06.10.2015 and to register a case.

2.The learned counsel for the petitioner submitted that the petitioner has filed a petition before the learned Judicial Magistrate No.III, Coimbatore, under Section 156(3) CrPC, which was taken on file in C.C.No.5083 of 2015 and that has been forwarded to the concerned respondent police for enquiry. After enquiry, the respondent police has submitted a report dated 29.01.2016 to the learned Judicial Magistrate No.III, Coimbatore, stating that no prima facie case has been made out to register a case. But, the said report has been received by the learned Magistrate on 02.02.2016. He further submitted that the respondent did not investigate the case properly and hence, this petition has been filed for the above stated relief.

The learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner approached the learned Judicial Magistrate by invoking Section 156(3) of CrPC. Subsequently, the learned Magistrate has forwarded the https://hcservices.ecourts.gov.in/hcservices/

same to the concerned respondent police for enquiry. After due enquiry, the matter has been closed and a copy of the closure report has been filed.

Considering the rival submissions made on both sides that there is no interference and hence, this Criminal Original Petition is dismissed.
