ORDER
The petitioner arrested on 13.06.2025 on the complaint given by one Shanmuga Lakshmanan alleging that he was robbed Rs.650/- at knife point by Page No.1/5
the accused persons while he was in his petty shop. A case has been registered against the petitioner for the offences under Sections 296(b), 311, 125, 351(3) of BNS Act, 2023. Earlier bail petition was dismissed by this Court on 14.07.2025 stating that investigation is still pending and the petitioner is involved in similar offences earlier and releasing the petitioner at this stage may affect ongoing investigation.
2. The learned counsel for the petitioner submitted that investigation is almost completed and the petitioner is ready to abide by any condition.
3. The learned Government Advocate (Criminal Side) for the respondent police states that in view of the antecedent of the petitioner, if he is granted bail, he may abscond and commit similar offences.
4. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent.
5. Considering the submissions, taking note of the fact that already the petitioner being inside the prison for nearly 58 days and so far the final report not yet filed, this Court is inclined to grant bail to the petitioner with certain conditions.

6. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned XV Metropolitan Magistrate, George Town, Chennai, and on further conditions that :
[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the Investigating Officer daily morning at 10.00a.m until further orders.
[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 11.08.2025 nr Note :
