This petition has been filed to condone the delay of 609 days in paying the deficit Court fee in the above appeal.

2. Being satisfied with the averments made in the affidavit, this Court is inclined to allow this petition. However, this Court is of the view that since the delay is only due to the fault on the part of the petitioner, the respondent is not liable to pay any interest on the enhanced amount for the delayed period of 609 days.

3. Accordingly, this petition is allowed and the delay of 609 days in paying the deficit Court fee in the above CMA is condonned subject to the waiver of interest on the enhanced compensation for the delayed period.
