Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 1st and 2nd respondents to survey and fence the property comprised in Sy. No.38/10F, ad-measuring to an extent of 2616 sq.ft., (0.06 cents-243.12 sq.mtrs) and the other property in survey No.38/4A1, New Natham survey No.48/4A, ad measuring to an extent of 0.04 cents (162.08 sq.mtrs) both are situated at Ulagampattu village, Chetput taluk, Tiruvannamalai District by obtaining necessary police protection from the 3rd and 4th respondents for carrying out the same in the smooth and peaceful manner by virtue of the survey charges of Rs.1,600/- paid vide Application No.2025/ 0123/ 06/012909 dated 20.03.2025 under the filed measure application and paid charges of Rs.860/- vide application No.2025/ N123/ 06/ 011269 dated 20.03.2025 under the Field Measure Application respectively.

Mrs.Indhubala, learned Additional Government Pleader takes notice on behalf of the respondents 1 and 2. With consent, the main writ 2/7

petition is taken up for final disposal at the stage of admission.

2. This Writ Petition has been filed seeking for a direction to the respondents to survey and fence the property comprised in Sy. No.38/10F, ad-measuring to an extent of 2616 sq.ft., (0.06 cents-243.12 sq.mtrs) and the other property in survey No.38/4A1, New Natham survey No.48/4A, ad measuring to an extent of 0.04 cents (162.08 sq.mtrs) both are situated at Ulagampattu village, chetput taluk, Tiruvannamalai District by obtaining necessary police protection from the 3rd and 4th respondents for carrying out the same in the smooth and peaceful manner by virtue of the survey charges of Rs.1,600/- paid vide Application No.2025/ 0123/ 06/012909 dated 20.03.2025 under the filed measure application and paid charges of Rs.860/- vide application No.2025/ N123/ 06/ 011269 dated 20.03.2025 under the Field Measure Application respectively.

3. None appeared on behalf of the petitioner. The case of the petitioner is the owner of the aforesaid property and he submitted the 3/7

application to the respondents to survey his property on 20.03.2025 and he has also paid necessary fees. However, the petitioner's application was not considered by the respondent till date, thus the present writ petition has been filed before this Court.

The learned Government Advocate appearing for the respondents 1 and 2 would submit that the respondent concerned would consider the petitioner's application and carry out a survey and fix boundary stones at the subject property within a time frame fixed by this Court, which was agreed to by the learned counsel for the petitioner.

In view thereof, the writ petition stands disposed of with the direction to the respondent concerned to consider the application of the petitioner dated 20.03.2025, carry out a survey, demarcate the property and thereafter fix boundary stones at the subject property, within a period of 4 weeks from the date of receipt of a copy of this order after giving prior notice and reasonable opportunity of hearing to the petitioner, adjacent land owners and other interested parties, including 4/7

rival claimants, if any. The respondents are at liberty to seek police protection, if need arises. No costs.

6. With the above directions, this writ petition is disposed of. No costs.
