(TM)A/97/2024 (T)OP(TM)/306/2023 SENTHILKUMAR RAMAMOORTHY,J By order dated 09.07.2024, the first respondent was set ex parte. By this application, the said respondent seeks to set aside the said order. In the affidavit in support of this application, it is stated that the first respondent filed a counter statement dated 26.10.2023 and was also present for all hearings, except the hearings in July 2024. As regards the hearings in July 2024, it is stated that the counsel was unwell and was, consequently, unable to travel to Chennai to represent the first respondent.

2. Learned counsel for the petitioner has no serious objection to this application being allowed.

4. In (T)OP(TM)/306/2023, parties are directed to agree upon and submit a common revised schedule for recording evidence. List the matter on 17.09.2024.
