The application has been filed seeking to condone the delay of 257 days in filing the written statement on behalf of the 1st defendant.
2. In the affidavit filed giving the reasons for the delay, it had been stated that even before the written statement could be filed, the defendants had been set exparte and the previous counsel, for personal reasons left the advocate office. Thereafter, instructions had to be given to prepare the written statement. Subsequently, by an application filed, the exparte decree had also been set aside. To prove the bonafide the written statement was not filed by the 1st defendant.
3. Heard the learned counsel for the plaintiffs also.
4. In order to give opportunity to all the parties to put forth their respective cases in the form of pleadings, I would condone the delay, taking into consideration the reasons given for the delay.
5. The application stands allowed. The written statement of the 1st defendant may be taken on record.
