Contempt petition filed under Section 11 of the Contempt of Courts Act, 1971 praying to punish the respondent for wilfully and deliberately violating the order dated 28.03.2024 made in WP.no.8108 of 2024. For Petitioner : Mr.B.Mohan For Respondent : Mr.R.Balaramesh

ORDER

This contempt petition has been filed praying to punish the respondent 1/4

for non compliance of the order passed by this Court dated 28.03.2024 made in WP.No.8108 of 2024, thereby the respondent herein was directed to settle the retirement benefits with applicable interest within a period of eight weeks.

It is seen that the respondent calculated the retirement benefits and disbursed the same of Rs.15,06,774/- to the petitioner herein. However, the learned counsel for the petitioner would submit that the retirement benefits was not calculated as per the calculation memo submitted by the petitioner. Further, the respondent did not pay any interest for the belated payment.

The learned counsel for the respondent submitted that there was audit objection and as such, there was delay. However, the petitioner may be given liberty to submit fresh representation for seeking interest and disputed amount.

Hence, if there is any due as per the calculation of the petitioner, he can submit fresh representation to the respondent and on 2/4

receipt of such representation, the respondent shall consider the same and pass appropriate orders in accordance with law. 5.
