The learned Senior Counsel representing the plaintiff as well as the 1st defendant, who has appeared as a Party-in-person are agreeable to go for Mediation Centre to resolve the dispute.

2. The applicant/plaintiff is having the benefit of the interim order in O.A. No.755 of 2023, ever since 05.09.2023 and in O.A. No.806 of 2023, ever since 03.10.2023. No useful purpose would be served if these applications are still kept pending. Therefore, the interim injunction granted by this Court in O.A. Nos.755 and 806 of 2023 are made absolute and both the applications are allowed as prayed for. However, it is made clear that making the interim injunction absolute in O.A. Nos.705 and 806 of 2023 will not cause any prejudice to the rights of the respondents / defendants in the main suit.

3. The observations made in the orders passed by this Court in O.A. No.755 and 806 of 2023 will not have any impact in the final outcome of the suit. Since the parties are agreeable for mediation, post the matter before the Madras High Court Mediation Centre on 22.11.2023.

4. Both the parties are directed to appear before the Madras High Court Mediation Centre on that date without fail and the Mediation centre shall appoint a suitable Mediator to mediate the dispute between the parties.

5. The Mediator appointed by the Madras High Court Mediation Centre is directed to submit a report to this Court, within a period of three weeks thereafter.

6. Post the matter on 13.12.2023.
