These applications have been filed by V.Pranwal Kadam, who was a minor when the Original Petition No.835 of 1999 had been filed.

The said O.P.No.835 of 1999 had been filed seeking permission to be appointed as legal guardian of the minor and for permission to sell the 2/3rd share in the schedule mentioned property at old Door No.12, 39 and 39A, present Door No.343, Trevelyan Basin Water Works Street, George Town, Chennai 600 079 measuring about 825 sq.ft.

By an order dated 09.02.2020 in the Original Petition, the relief was granted and it was directed that after effecting the sale of the property, the sale proceeds should be deposited in a Nationalised Bank in Fixed Deposits and that the interest could be withdrawn. But naturally, when the minor attained the age of majority, he would have every authority to withdrawn the amount.

4. These applications have been filed since the minor has now attained the age of majority. They had been filed seeking a declaration that he had attained the age of majority and consequently, to discharge the guardian and more importantly to withdraw the amount lying in the Court deposit.

5. Heard the learned counsel for the petitioner.

6. It is stated by the learned counsel that the amount had been converted to the Fixed Deposit and the Fixed Deposit Receipts are now in the custody of the Registrar of the Original Side.

7. Since, the minor has become the major he has every legal authority to take a decision by himself. He has to be declared as major and his guardian has to be discharged. He has every right to withdraw the amount lying in his name in the Fixed Deposits with the Registrar of the Original Side. The applications stands allowed.

8. The Registry may present the Fixed Deposits Receipts for payment with request to transfer the amount to the account of the petitioner. I would however, place a caveat that the learned counsel may advice the minor to exercise discretion in managing the amount.

9. These applications are allowed.
