C.M.P.No.21159 of 2023 in C.M.A.No.1857 of 2018 C.M.P.No.21159 of 2023 in C.M.A.No.1857 of 2018 P.VELMURUGAN, J., This miscellaneous petition has been filed seeking to order substitute service on the fifth respondent, who is the owner of the offending vehicle. The learned counsel for the petitioner/appellant/Insurance Company would submit that the notices sent to 5th respondent were returned as 'no such addressee' and 'door locked'. Despite much efforts, he could not serve notice on 5th respondent. Hence this petition.

Heard the learned counsel for the petitioner. Having satisfied with the reasons stated in the affidavit filed in support of this miscellaneous petition, the petitioner is permitted to effect substituted service on the fifth respondent's last known address by effecting paper publication in one issue of 'Dhina Malar', having wide circulation indicating the date of hearing as 27.09.2023. Proof of such paper publication shall be filed before this Court on or before 25.09.2023.

This petition is ordered, accordingly.
