ORDER

This petition has been filed by the petitioners praying to quash the First Information Report in Crime No.531 of 2014 on the file of the 1st respondent-Police. The petitioner herein is the first accused in this case.

2.The 2nd respondent/defacto-complainant lodged the complaint as against the petitioners stating that she is the tenant under the 1st petitioner; that she is running fruit shop

at No.4/18, Valluvar Salai, Ramapuram Chennai and the said property belongs to the petitioner. On 08.06.2014, the petitioners along with rowdy elements entered into the shop of the defacto-complainant and threw out the materials outside and damaged the materials. When the same was questioned by the defacto-complainant, they threatened the petitioner with dire consequences. On the basis of the complaint lodged by the defacto-complaint, a case in Crime No.531 of 2014 under Sections 147, 148, 294(b), 341, 324, 427, 447, & 506(ii) IPC. Now, the petitioners have come forward with the present petition seeking to quash the complaint.

3.Today, when the matter is taken up for consideration, the petitioners and the defacto-complainant are present. It is represented by both sides that the matter has been amicably settled between the parties. A consent affidavit has been filed by the 2nd respondent/defacto-complainant stating that the matter has been amicably settled and she has not objection to quash the impugned criminal proceedings.

4.Heard both sides and and perused the materials available on record.

5.Considering the facts and circumstances of the case and in view of the compromise arrived at between the parties, I am of the opinion that the First Information Report in Crime No.531 of 2014 pending on the file of the 1st respondent-Police, is liable to be quashed and accordingly, the same is quashed.
