O R D E R

By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.

2. The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the Respondents to disburse the amount for 90 days and 240 days of private affairs leave encashment together with interest at the rate of 12% P.A for the delayed period till the date of payment within the stipulated time as may be fixed by this Court.

3. Heard the learned counsel for both sides and perused the materials available on record.

4. The learned counsel for the petitioner would submit that the 2/6

petitioner was appointed as an employee in the Dharmapuri District Cooperative Milk Producers' Union on 15.05.1980 and on attaining the age of superannuation, he retired from service on 30.06.2013 as Special Grade Senior Factory Assistant. The learned counsel for the petitioner would submit that he is entitled for leave surrender amount. Hence, he has sent a representation to the respondents on 10.10.2022 and such representation is pending with the respondents. The learned counsel for the petitioner would further invite the attention of this Court that the 2nd respondent has forwarded the petitioner's representation to the 3rd respondent.

At this juncture, the learned Government Advocate appearing for the respondents 1 and 2 as well as the learned Standing Counsel appearing for the 3rd respondent would submit that they will consider the petitioner's representation according to it's own merits and in accordance with law, within a reasonable time.

6. In such view of the submission, without going into the merits of the writ petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 10.10.2022 and pass orders on 3/6

it's own merits and in accordance with law, within a period of eight weeks from the date of receipt of copy of this order. If the petitioner is otherwise eligible for any amount, the respondents are directed to settle the same along with applicable interest.
