This Criminal Miscellaneous Petition has been filed to modify the condition imposed on the petitioner while granting bail by this Court in Crl.O.P.NO.22399 of 2022 on 26.09.2022.

2. The learned Counsel for the petitioner would submit that, this Court while granting bail to the petitioner directed the petitioner to execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties (out of which, one surety should be either the father or mother of the petitioner), each for a like sum to the satisfaction of the learned Special Judge for EC/NDPS Act, Cases at Salem. He would further submit that the petitioner is a resident of Kerala and neither the petitioner nor his parents are able to obtain solvency certificate from the Revenue Department. Despite the bail being granted to the petitioner on 26.09.2022, the petitioner was unable to come out of bail. However, he would submit that the sureties are ready to deposit a sum of Rs.25,000/- each to the credit of the Crime Number as surety amount. 1/3

In view of the above, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000 /- (Rupees Twenty Five Thousand Only) with two sureties and the sureties shall deposit a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the credit of Crime Number as cash surety before the satisfaction of the learned Special Judge for EC/NDPS Act, Cases at Salem. The other conditions imposed shall remain unaltered.

4. With the above modifications, this criminal miscellaneous petition is ordered.
