This petition has been filed to modify the condition imposed by this court by an order dated 12.01.2023 in the above Criminal Original Petition that the petitioner shall deposit a sum of Rs.5,00,000/- to the credit of Crime No.17 of 2022 before the learned Judicial Magistrate No.II, Tiruppur within a period of two weeks.
2. Today, when the matter taken up for hearing, the learned Government Advocate would submit that as per the condition imposed by this court while granting anticipatory bail, the petitioner has not deposited the amount as on date.
3. On seeing facts, the investigation reveals that they have received jewels from the defacto complainant and when this court enquired about the shop viz., Akshaya Jewellers, learned Government Advocate informed that the said shop was closed as on date. Furthermore, the condition imposed by 1/3
this court has not been complied with by the petitioner. But, the learned counsel for petitioner would submit that since the charge sheet was filed, the application for granting anticipatory bail need not be applicable to the petitioner. However, while granting anticipatory bail, the investigation is at the initial stage and now the investigation was completed. Therefore, this Court is not inclined to modify the condition imposed by this court by an order dated 12.01.2023 in Crl.O.P.No. 574 of 2023. Accordingly, this Criminal Miscellaneous Petition is dismissed. 03.01.2024 rpp 2/3
