judgment and decree dated 30.06.2015 made in C.M.A.Nos.49 and 50 of 2014 on the file of XVII Additional City Court, Chennai within the time stipulated by this Court.

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
2. The present writ petition has been filed challenging the refusal check slip issued by the 2nd respondent in RFL/Anna Nagar/89/2025 dated 09.07.2025. The challenge is on the premise that the impugned order insofar it refuses to register decree of Court on the premise that registration would be made only on establishment of right/title over the property as per Circular No.34940/C1/2019 dated 27.02.2023 in para 9(d) of the Inspector
General of Registration, and directing petitioner to submit documents to establish his right is illegal stands vitiated. Learned Counsel for Petitioner would further submit that the 2nd respondent may be directed to register the judgment and decree dated 05.01.2016 made in O.S.Nos.8244 and 8283 of 2010 on the file of XIII Assistant City Civil Court, Chennai and register the judgment and decree dated 30.06.2015 made in C.M.A.Nos.49 and 50 of 2014 on the file of XVII Additional City Court, Chennai within the time stipulated by this Court.

At the outset, learned Government Advocate appearing for respondents would submit that enquiry over title is impermissible, and petitioner may re-present the judgment and decree and the same would be registered, if it is otherwise in order. If for any reason, registration is sought to be refused, a refusal check slip would be issued after assigning reason, which was agreed to by learned counsel for petitioner.
4. In the light of the above submission, this Court is inclined to interfere with the impugned order passed by 2nd the respondent dated 09.07.2025 and accordingly, the same is hereby set aside. It is open to the petitioner to re-present the judgment and decree before the respondents and on such re-presentation, respondents shall register the judgment and decree, if it is otherwise in order. If for any reason, the Registering Authority refuses to register the judgment and decree, he shall do so after assigning appropriate reasons in the refusal slip/ order.
5. In the result, this Writ Petition stands disposed of. However, there shall be no orders to costs.
