Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the First Respondent to consider the representation submitted by the Petitioner dated 05.03.2019 and consequential relief to direct the First Respondent to initiate action as against the Second Respondent to cancel the trade license issued in favour of the Second Respondent.

Heard Mr. T. Ramachandran, Learned Counsel for the Petitioner and Mr. T. M. Pappiah, Learned Special Government Pleader for the First Respondent and perused the materials placed on record, apart from the pleadings of the parties. 2.

It is pointed out by the Learned Special Government Pleader appearing for the First Respondent that having regard to the nature of relief sought by the Petitioner in his representation dated 05.03.2019, which is sought to be disposed in this Writ Petition, the Petitioner has to approach the jurisdictional Registrar for arbitration under Section 64 of Chit Funds Act, 1982, in respect of any dispute touching the management of a chit business of the Petitioner.

In view of the same, Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to the Petitioner to resort to the aforesaid remedy and he has made an endorsement to that effect, which is recorded. 4.

Recording the same, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
