Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to direct the second respondent to issue non traceable certificate in respect of the original Sale Deed bearing Document No.1693 of 1980, on the file of the Sub Registrar, Poonamallee, as sought for by the petitioner vide his complaint dated 19.08.2022 which was lost by the petitioner.

O R D E R

This Criminal Original Petition has been filed seeking for a direction to the second respondent police to issue non traceable certificate in respect of the original Sale Deed bearing Document No.1693 of 1980, on the file of the Sub Registrar, Poonamallee.

The learned counsel appearing for the petitioner submitted that the complaint has been given by the petitioner on 19.08.2022 by alleging that his original Sale Deed vide Document No.1693 of 1980, on the file of the Sub Registrar, Poonamallee, was lost while he was travelling on 17.08.2022 in a bus from his house to Tambaram. Since the complaint was not taken on file, he has sent online complaint on 22.08.2022, which was received by the second respondent police. The grievance of the petitioner is that so far the missing certificate was not given. 3.

The learned Additional Public Prosecutor appearing for the respondents attracted the attention of this Court about certain guidelines issued by the Director General of Police while issuing non traceable 2/5

certificate on receipt of the petition relating to the lost of original land documents.

According to the petitioner, he has produced all the documents stated in the above said Circular is issued by the Director General of Police but still the second respondent police has not considered and issued the non traceable certificate. If the petitioner has complied all the essential requirements as stated in the Circular, it will be appropriate for the second respondent police to issue non traceable certificate. 5.

In view of the above, the second respondent police is directed to verify whether the documents produced by the petitioner are sufficient enough to conclude the enquiry and issue non traceable certificate. Thereafter, to complete the investigation within a period of one month from the date of receipt of a copy of this order.

With these observations, this Criminal Original Petition is disposed of.
