This petition is filed to condone the delay of 707 days in paying the deficit Court fee of Rs.4,424.50/-.

Learned counsel for the petitioners submitted that they paid Court fee as per the Unamended Tamil Nadu Court Fees and suits Valuation Act. After, 11 month, Court fee was enhanced and therefore, there was a delay in paying the deficit Court fee. That apart, there are certain correction to be made in the decree in A.S.No.46/2017. An application, in I.A.No.1/2019, was filed for amending the decree, that was allowed on 02.03.2001, subsequently, covid-19 situation followed. Therefore, there is a delay.

Considering the reasons stated by the learned counsel for the petitioners and accepting the reasons, the delay of 707 days in filing the deficit Court fee of Rs.4,424.50/-, is condoned and the petition is ordered. 07.01.2022 AT Note: Office is directed to number the second appeal, if it is otherwise in order. https://www.mhc.tn.gov.in/judis 1/2
