In All Petitions For Appellant(s) : Mr.Siva Pandiya Mani for Mr.R.Rajarajan For Respondent(s) : No appearance COMMON ORDER Consequent upon the death of the first appellant, these four applications have been filed to set aside the order of dismissal dated 12.04.2024, seeking condonation of delay of 38 days in filing the application, seeking setting aside of abatement, and to bring on record the legal representatives of the deceased first appellant on record as the appellants 5 to 7. Though the learned Special Government Pleader took notice and sought time for getting instructions as early as on 31.10.2025, no counter-affidavit has been filed till date and there is no appearance for the respondents.

2. Today, when the matter is taken up for consideration, this court, after having gone through the affidavit filed in support of the applications, is convinced that there is sufficient reason for the delay of 38 days and accordingly, the said delay is condoned. Consequently, the application filed seeking setting aside abatement as well as to bring on record the petitions 5 to 7 herein as the appellants 5 to 7, being the legal representatives of the deceased first appellant, and to set aside the order of dismissal dated 12.04.2024 are ordered.

3. Registry is directed to carryout necessary amendments and list the second appeal for hearing on 06.03.2026.
