2. Though the 1st respondent has been served and his name being printed in the cause list, none entered appearance on behalf of him either in person or through counsel.
3. Heard the learned counsel appearing for the petitioner and the 2nd respondent.
4. Considering the averments made in the affidavit filed in support of this petition and being satisfied with the same, the delay of 64 days in preferring the appeal is condoned.
