1. The criminal miscellaneous petition has been filed seeking to condone the delay of 38 days in filing the revision against the order dated 24.09.2019 passed in C.A.No.37 of 2019 on the file of the learned Principal Sessions Judge, Erode.

2. Heard both sides.

3. The learned counsel for the petitioner would submit that the petitioner was arrested and he is in prison and that the entire cheque amount has been paid and the respondent complainant had received the entire amount and that since the petitioner is in jail, he is unable to file the compounding petition.

4. Having satisfied with the reasons stated in the affidavit filed in support of the petition, the delay of 38 days in filing the revision is condoned. The petition is ordered accordingly.

5. The Registry is directed to number the revision if papers are otherwise in order and post the matter on 25.09.2019.
