ORDER
This writ petition is filed seeking for the issuance of Writ of Mandamus to direct the 1st respondent to pass orders on the Appeal dated 07.03.2022 filed by the petitioner challenging the cancellation of patta in respect of plot measuring 80 square meters in S.F.No.76/31 situated at Shoolagiri Village, 1/4
Krishnagiri District.
2.The case of the petitioner is that his father was granted with an house site as per the Revenue Standing Order with 80 square meteres of vacant land in S.F.No.76/31 vide HSD No.92/1410, wherein, his father constructed a house and in the back portion and a petty shop in the front side. Subsequently, upon his death, the petitioner leased out the shop to Mr. Arumugam for running old iron scrap business. While so, during the land acquisition, their house portion was acquired and the petitioner moved to another rental place and the second respondent vide proceedings in Na.Ka.No.6329/20212/A2 dated 07.02.2022 cancelled the HSD patta on the ground that the beneficiaries have not put up construction in the sites granted. The grievance of the petitioner is that they were not provided with opportunity of hearing. Hence, they made an appeal before the first respondent on 07.03.2022, enquiry was conducted, no orders were passed till date. Hence, this petition.
3. The learned counsel for the petitioner seeks this Court for issuance of direction for the first respondent to pass orders on the petitioner's appeal dated 07.03.2022 within a reasonable time as fixed by this Hon'ble Court. 2/4
4. Heard the learned Additional Government Pleader appearing for the respondents and perused the materials available on record.
5. Considering the limited relief sought for by the petitioner, this Court directs the first respondent to conclude the proceedings in the Appeal filed by the petitioner on 07.03.2022 and pass order(s) on merits and in accordance with law, after providing reasonable opportunity of hearing to the petitioner well as any other interested parties, within a period of twelve weeks from the date of receipt of copy of this order.
