Prayer :- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the first respondent to pass appropriate orders on the appeal made by the petitioner dated 09.08.2021 in the light of the communication in O.Mu.No.1061/2021/C dated 01.09.2021 sent to the second respondent and to cancel the joint patta No.22 in respect of the property comprised in survey No.37/10, 37/10A, 37/10A1 and 37/10A2 and to restore the same in its original position as Survey No.37/10 situated at Kottamettuppatti Village, Omalur Taluk, Salem District forthwith. ORDER
This writ petition is filed for direction directing the first respondent to pass appropriate orders on the appeal made by the petitioner dated 09.08.2021 in the light of the communication in O.Mu.No.1061/2021/C dated 01.09.2021 sent to https://hcservices.ecourts.gov.in/hcservices/
the second respondent and to cancel the joint patta No.22 in respect of the property comprised in survey No.37/10, 37/10A, 37/10A1 and 37/10A2 and to restore the same in its original position as Survey No.37/10 situated at Kottamettuppatti Village, Omalur Taluk, Salem District forthwith.
2. The petitioner filed appeal challenging the issuance of patta in favour of the respondents 3 to 5 herein, which is pending on the file of the first respondent. Considering the same, the first respondent is directed to issue notice to the petitioner and the counter parties i.e. respondents 3 to 5 herein and, on receipt of the report from the second respondent and after giving opportunity of hearing to the petitioner and the respondents 3 to 5 herein, pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of copy of this order.
3. With the above direction, this writ petition is disposed of. No order as to costs.
