BY [ RESPONDENT ] THE INSPECTOR OF POLICE, H-1, WASHERMENPET TRAFFIC, INVESTIGATION WING, CHENNAI, (CR.NO.178/H1/2014).

Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition imposed by this Honourable Court directing the petitioner herein to appear before the learned III Metropolitan Magistrate, George Town, on the first working day of every week at 10.30 a.m. until further orders in Crl.M.P.No.6520 of 19 in CRL.R.C.NO.424 OF 19 dated 09.05.2019. [CRL.MP.NO.13472/2019] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S. R.GANESH KUMAR, Advocate for the petitioner and of MR.T.SHUNMUGARAJESWARAN Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This court petition by the order dated 09.05.2019 has suspended the sentence awarded to the petitioner by the Trial court on a condition that he has to execute a bond for a sum of Rs.10,000/- with two sureties each for a like sum to the satisfaction of the trial Court and appear before the Trial Court on the first working day of every week at 10.30 a.m., until further orders.

2. This petition has been filed by the petitioner / accused to modify the condition that he should appear before the Trial Court on the first working of every week at 10.30 a.m., until further orders.

3. According to the learned counsel for the petitioner, the petitioner is being a driver, he is not able to appear before the Trial Court on the first working of every week and hence he requests to modify the said condition and permit the petitioner to appear before the Trial Court on the first working day of every month. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate (Crl.Side) who is appearing for the respondent has not raised any objection for modifying the said condition.

5. Considering the aforesaid submissions, the condition imposed by this Court by the order dated 09.05.2019 is modified to the effect that the petitioner shall appear before the Trial Court on the first working day of every month at 10.30 a.m., until further orders. -sd/- 03/03/2020 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
