2. These Transfer Civil Miscellaneous Petitions are filed under Section 24 of the Code of Civil Procedure seeking withdrawal of (i) H.M.O.P. No.290 of 2023 pending on the file of the Subordinate Judge, Ambattur and (ii) H.M.O.P. No.189 of 2024 pending on the file of the Subordinate Judge, Ambattur, and to transfer the same to the file of the Family Court, Chennai. 2/5

3. The petitioner is the wife. It is stated that the petitioner is residing at Thiru.Vi.Ka. Nagar, Chennai, and the respondent/husband is residing at Padi, Chennai. There is no appearance for the respondent.

4. The petitioner states that she is taking care of the minor girl child and that she finds it difficult to travel and attend the proceedings at Ambattur on every hearing, and seeks transfer of both proceedings to the Family Court, Chennai. It is also stated that the respondent is working at Perambur and would not be prejudiced if the matters are heard by the Family Court, Chennai. It is further stated that H.M.O.P. No.189 of 2024 filed by the petitioner for restitution of conjugal rights is being enquired along with the divorce petition in H.M.O.P. No.290 of 2023 and is now posted for ex parte evidence.

5. Having regard to the convenience of the petitioner, and considering that both parties are stated to be residing within Chennai, this Court is satisfied that the transfer sought is to be ordered.

6. Accordingly, Tr.C.M.P. Nos.1152 and 1153 of 2025 are allowed and the following directions are issued; H.M.O.P. No.290 of 2023 and H.M.O.P. No.189 of 2024, pending on the file of the Subordinate Judge, Ambattur, are withdrawn and 3/5

transferred to the file of the Family Court, Chennai. The Subordinate Judge, Ambattur shall transmit the entire records forthwith to the Family Court, Chennai. The Family Court, Chennai shall take up both matters together and proceed in accordance with law as expeditiously as possible. No costs. Consequently, the connected C.M.P.s, if any, stand closed.
