This petition is filed under Section 378(3) Cr.P.C, to grant leave to file an appeal against the judgment dated 08.06.2023 made in S.T.C.No.196/2021 on the file of the Judicial Magistrate Court No.1, Udumalpet.

2. Heard Mr.S. Kasirajan, learned counsel for the petitioner.

3. Learned counsel for the petitioner/appellant contended that though the accused admitted his signature on the cheque, the trial court had acquitted the accused by observing that the complainant in his complaint has not mentioned the date of borrowal by the accused. According to him, there are arguable points in the present appeal and therefore, prayed for allowing this petition. 1/2
