Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the second respondent to return and release the Rectification Deed, dated 03.08.2016 registered as pending document No.P201600143 (143 of 2016) at the second respondent office to the petitioner. ORDER
This Writ Petition has been filed to direct the second respondent to return and release the Rectification Deed, dated 03.08.2016 to the petitioner.
2.Heard the learned counsel for the petitioner and the learned counsel for the respondents.
3. According to the petitioner, when the sale deed was executed in his favour, the length and measurements have been wrongly given. He would further state that survey number is not changed, four boundaries have not been changed and even the total extent has not been changed and that only the measurement have been wrongly mentioned and sought to be rectified by presenting a Rectification deed. He would further submit that there is no consideration in execution of the said Rectification.
Even thought the rectification deed was registered as pending document as early as on 03.08.2016, the said document has not been released. Hence, he has come forward with the present Writ Petition.
4. The learned Additional Government Pleader would submit that the petitioner without giving any representation to the respondents in this regard, has straight away filed this Writ Petition. He further submitted that the authority will look into the matter in accordance with law.
5. In such view of the matter, the petitioner is directed to approach the authority concerned and the authority will decide the matter in accordance with law within a period of two months from the date of receipt of a copy of this order.
6. With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
