2. The learned counsel for the petitioner would submit that the respondent is harassing the petitioner under the guise of enquiry and hence, the petitioner has come forward with this petition for the above stated relief.
3. Resisting the same, the learned Additional Public Prosecutor would submit that the petitioner is a suspected accused in Crime No.205 of 2016 and therefore, he was called for enquiry. However, the petitioner without appearing before the respondent police, came forward with this petition. He further submitted that the petitioner may be directed to appear before the respondent police for investigation.
4. On a perusal of the records, it is seen that the petitioner was directed to appear before the respondent police on https://hcservices.ecourts.gov.in/hcservices/
20.03.2016 at 11.00 a.m. Further, the petitioner is a suspected accused in Crime No.205 of 2016. The petitioner has not chosen to appear before the respondent police on the above said date, but, has filed this petition seeking a direction to the respondent not to harass him. In the circumstances, this Court is not inclined to pass orders in favour of the petitioner. However, this Court directs the respondent police to issue fresh summons to the petitioner for his appearance and on receipt of the same, the petitioner is directed to appear before the respondent police and co-operate with them for investigation.
5. The Criminal Original Petition is disposed of with the above direction.
