JUDGMENT

Both parties are present. A joint memorandum of compromise duly signed by both the parties and the counsel is filed. The Civil Miscellaneous Appeal is disposed of in terms of joint memo of Page 1/4

compromise entered into between the parties.

2. The Joint memo of compromise filed by the parties dated 22.06.2023 is extracted hereunder:

1. It is submitted that both the appellant and the respondent conceded with each other to file the present Memo jointly, to dissolve the marriage held between them as the marriage between them is irretrievably broken down and there is no possibility for reunion or a chance to live together.

2. It is submitted that both the apppellant and the respondent are consented to withdraw their respective allegations against each other and by way of considering the long period of 13 years separation the marriage held between them on 24.03.2002 at Theni Melapettai Hindu Nadar Uravin Murai Kalyana Mandapam, 1100, Periakulam Road, Theni District, may be dissolved. Both the Appellant and the respondent have no claim or right over each other in anyway hereafter.

3. Both the appellant and the respondent declare that without any force, fraud, coercion or undue influence against each other or from anybody filing the present joint memo before this Hon'ble Bench.

4. It is submitted that in the above circumstances Page 2/4

both the appellant and the respondent prayed for the grant of a decree of divorce dissolving the marriage held between the appellant and the respondent on 24.03.2002 at Theni Melapettai Hindu Nadar Uravin Murai Kalyana Mandapam, 1100, Periakulam Road, Theni District and the present Memo is filed to that effect."

The terms of the compromise shall form part of the decree.

3. In the result, the Civil Miscellaneous Petition is disposed of by dissolving the marriage between the appellant and the respondent held on 24.03.2002 at Theni Melapettai Hindu Nadar Uravin Murai Kalyana Mandapam, 1100, Periakulam Road, Theni District.
