Respondents PRAYER:-Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 3rd respondent herein to give direction to the Revenue Inspector, Village Administrative Officer, Head Surveyor and Survey to take the lenient measurement with respect to Survey No.89/2A and demarcating the land so as to enable us to mark the boundaries by putting the boundary stones (Kanikal) and also fencing our property by virtue of revenue records in view of the representation given by the 1st petitioner and by giving credence to the challan No.76 dated 29.08.2019, paid towards survey of land and consequently direct the 4th respondent to grant adequate police protection to both the petitioners as well as the revenue authorities in pursuance of the property on the date of taking measurement.

O R D E R

This Writ Petition is filed, to direct the the third respondent herein to give direction to the Revenue Inspector, Village Administrative Officer, Head Surveyor and Survey to take the measurement with respect to Survey No.89/2A and demarcating the land so as to enable us to mark the boundaries by putting the boundary stones (Kanikal) and also fencing our property by virtue of revenue records in view of the representation given by the 1st petitioner and by giving credence to the challan No.76 dated 29.08.2019, paid towards survey of land and consequently direct the 4th respondent to grant adequate police protection to both the petitioners as well as the revenue authorities in pursuance of the property on the date of taking measurement.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 4.

3. The petitioner herein claims that the property to an extent of 51 cents in S.Nos.89/1 and 89/2 was purchased by his father and now in possession and enjoyment of the petitioner. When the petitioner gave a representation to the third respondent to measure the land, they have not discharged their responsibility. Hence, the present Writ Petition is filed.

4. The learned Additional Government Pleader appearing for the Tahsildar-third respondent states that the request of the petitioner to measure land in S.No.89/2 was taken for consideration and it was measured on 18.11.2019 with aided of police. Hence, nothing survives in this Writ Petition.

5. The learned counsel appearing for the petitioner states that the police may be directed to give protection for fencing the land. Said requisited is not part of the Writ Petition. It is the duty of the police to provide protection in case of any request made by the petitioner herein.

6. With these observations, this Writ Petition is dismissed as infructuous. No costs. Consequently, connected W.M.P is closed.
