ORDER
[Order of the Court was made by P.N.PRAKASH, J.] This habeas corpus petition has been filed seeking a direction to the 2nd respondent to trace out the whereabouts of the petitioner's daughter viz., Lakshmi Priya, aged about 21 years and granddaughter viz., Abiksha, aged about 11⁄2 years and produce them before this Court.
2.It is the case of the petitioner that her daughter Lakshmi Priya got married to Sathish Kumar sometime in the year 2018 and they were blessed with a female child viz., Abiksha, aged about 11⁄2 years; while that being so, her daughter and granddaughter went missing from 31.08.2021 and thereafter, her whereabouts are not known.
3.Today, S.Prabaharan (Mobile No.94981 73937), SubInspector of Police, Periyanaickenpalayam Police Station, Coimbatore District, is present.
4.On instructions, the learned Additional Public Prosecutor submitted that on a complaint given by Sathish Kumar, husband of the detenue Lakshmi Priya, a case in Periyanaickenpalayam Police Station Crime No.1031 of 2021 has been registered on 04.09.2021 for 'women and girl missing' and during the investigation, it came to light that the detenue Lakshmi Priya has eloped with Karthik, third respondent herein. He further submitted that this is not the first time Lakshmi Priya has run way with Karthik; earlier on 21.08.2021, Lakshmi Priya has gone away with Karthik and thereafter, secured by Sathish Kumar.
In such view of the matter, this habeas corpus petition stands closed with a direction to the Deputy Superintendent of Police, Periyanaickenpalayam Sub-Division, to supervise the investigation in Periyanaickenpalayam Police Station Crime No.1031 of 2021 and keep the petitioner and Sathish Kumar informed of the developments, if any. As and when Lakshmi Priya, aged about 21 years and Abiksha, aged about 11⁄2 years, are secured, they shall be produced before the Judicial Magistrate Court No.V, Coimbatore, under intimation to the petitioner and Sathish Kumar. On such production, the learned Magistrate shall pass appropriate orders with regard to custody in accordance with law.
