Respondents Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus forbearing the respondents from disturbing the petitioner's peaceful possession and enjoyment of the property having an extent of 690 sq.ft., situated at Southern side of East Coast Road, Lawspet, Karuvadikupam Revenue Village, Cillage No.39, comprised in Re-survey No.140/6, Cadastre No.449/1pt, 450, in Patta No.92 having extent of 8 Ares within Uzhavakarai Municipality, Uzhavakkarai Sub Registration District and Puducherry Registration District.

The learned counsel for the petitioner seeks permission of this Court to withdraw this writ petition with liberty to file a civil suit and he has also made an endorsement in the petition to that effect. In view of the submission and in view of the endorsement made by the learned counsel for the petitioner, this writ petition is dismissed as withdrawn. Liberty sought for, is granted. No costs.
