Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the respondent Nos.1 to 3 to transfer the petitioner from ESI dispensary, Perumanallur, Tirupur District to office of the respondent No.4 or any other ESI Dispensary near Theni District or any other further relief based on the representation given by the petitioner dated 21.06.2025 and 14.07.2025 and this Honourable Court fix stipulated time.

The writ petition has been filed for the following reliefs:- "directing the respondent Nos.1 to 3 to transfer the petitioner from ESI dispensary, Perumanallur, Tirupur District to office of the respondent No.4 or any other ESI Dispensary near Theni District or any other further relief based on the representation given by the petitioner dated 21.06.2025 and 14.07.2025 and this Honourable Court fix stipulated time.
2.The case of the petitioner is that she had joined the 9th Respondent Department as an Assistant on 13.12.2012 after clearing Combined Subordinate Services Examination I of the year 2011-12.
3. The petitioner would submit that on 19.08.2024, she had given a representation to the 2nd respondent through the 9th respondent requesting transfer to her native District Theni on the grounds of disability.
4. While so, the 2nd respondent vide proceedings dated 27.09.2024 had issued a promotion list of 59 persons including the petitioner from Assistant to Office Superintendent. Pursuant to which, she had joined as Officer Superintendent in the ESI Dispensary, Perumanallur, Tirupur 3/7
District.
5. As the petitioner being a disabled person, divorced and her son and old aged parents are dependent on her, she had made several representations seeking transfer to her native District so as to enable her to take care of herself and her dependent family members. However, the same have not been considered to date. Hence, the Writ Petition.
6. Heard the learned counsel on either side.
7. Considering the facts and circumstances of the case and taking note of the fact that the respondents are duty bound to dispose of statutory representation, the Writ Petition is allowed. The respondents 1 to 3 are directed to consider the petitioner's representations dated 21.06.2025 and 14.07.2025 in accordance with law and pass orders within a period of 2 months from the date of receipt of a copy of this order.
