ORDER

By this application, the plaintiff seeks the condonation of the delay of 335 days in filing the application to set aside the order dated 03.04.2024. By 1/2 https://www.mhc.tn.gov.in/judis

SENTHILKUMAR RAMAMOORTHY,J rna order dated 03.04.2024, the suit was dismissed for non-prosecution. In the affidavit in support of this application, it is stated that the order was passed before counsel could reach the Court. It is also stated that the application for restoration was filed on 03.06.2024, but that there were discrepancies in uploading the application in the e-filing portal.

2. Except the second defendant, who passed away after the suit was instituted, the other defendants have entered appearance through counsel. Only learned counsel for the fourth defendant is present. He has no objection to the application being allowed.

3. Upon examining the reasons set out in the affidavit and being satisfied that sufficient cause is shown, this application is allowed as prayed for.
