This miscellaneous petition has been filed seeking to condone the delay of 456 days in filing this Civil Miscellaneous Appeal.

2. Heard the learned counsel for the appellant and perused the materials available on record.

3. Delay is condoned not on the grounds stated by the appellant in the affidavit filed in support of this petition but only on the ground, if the petition is dismissed the appellant would further drag on the proceedings by filing an appeal before the appellate Court and hence in order to avoid this delay and put a quietus to this issue, this petition is ordered and the delay of 456 days in filing the Civil Miscellaneous Appeal is condoned.
