ORDER

This writ petition has been filed for the issue of a writ of mandamus directing the respondents to consider the representation made by the petitioner on 26.05.2023, wherein the petitioner is seeking for including her name in the legal heirship certificate that was issued in the name of Mr.K.Rangasamy Devar.

2. Heard Ms.Kavitha, learned counsel for the petitioner and Mr.R.Neelakandan, learned Additional Advocate General appearing on behalf of the respondents.

3. The case of the petitioner is that she is the granddaughter of K.Rangasamy Devar. The said K.Rangasamy Devar died on 18.07.1991. The further case of the petitioner is that her mother predeceased K.Rangasamy Devar in the year 1983 itself. Therefore, the name of the petitioner ought to have been added in the legal heirship certificate since she comes within Class-I legal heir under the schedule to the Hindu Succession Act, 1956. The further case of the petitioner is that a suit for partition was filed by the petitioner and a decree came to be passed in O.S.No.50 of 2012 dated 04.04.2017 on the file of I Additional District Court at Coimbatore and the petitioner was also given a share in the property belonging to the said K.Rangasamy Devar.

4. In the considered view of this Court, the petitioner has to submit a proper application before the 2 nd respondent by paying the necessary charges. On receipt of the same, the 2 nd respondent shall conduct an inquiry, collect all the relevant documents and take a decision regarding including the name of the petitioner in the legal heirship certificate within a period of six (6) weeks from Page No.3 of 6

the date of receipt of the application from the petitioner.

5. This Writ Petition is disposed of with the above directions.
