ORDER

(The Order of the Court was made by P.Velmurugan,J) The petitioner has filed the present Writ Petition praying for issuance of a Writ of Certiorarified Mandamus to call for the records pertaining with an impugned order in No.616/tha.ku.2/2025, dated 23.05.2025 by the first respondent and quash the same and direct the respondents to grant 28 days ordinary leave without escort to the petitioner.

2. By the said proceedings dated 23.05.2025, the first respondent rejected the request of the petitioner for ordinary leave on the ground that there is a life threat.

Learned counsel for the petitioner submitted that despite the request for leave made before the Probationary Officer, the same was refused with a direction to make the recommendation before the first respondent, but the first respondent rejected the request of the petitioner, against which, the present Writ Petition is filed by the Convict Prisoner seeking for grant of 28 days Ordinary Leave.

4. Since the petitioner has already completed six years of imprisonment/sentence, he is eligible for ordinary leave. However, due to life threat, the first respondent refused to grant the ordinary leave.

5. The petitioner wants to make arrangement for his marriage by choosing a suitable bride and to make arrangements for livelihood of his family, as he lost his parents and there is only one brother for him.

6. Taking into account the facts and circumstances of the case and considering the above request of the life convict (petitioner), the impugned order is quashed. The petitioner is granted ordinary leave for 28 days, with one Escort and the petitioner shall bear the expenses of the one Escort. The ordinary leave of the petitioner, shall commence from 19.12.2025 (Friday) and shall end on 15.01.2026 (Thursday).

On completion of the above said 28 days of ordinary leave, the Escort is directed to produce the petitioner-convict, before the second respondentSuperintendent of Prison, Central Prison Coimbatore, on the 29th day, i.e. on 16.01.2026 (Friday) at 10.30 am and the second respondent is thereafter directed to confine the petitioner to the Central Prison, Coimbatore, after completing the regular formalities of confinement and thereafter, the petitioner/convict prisoner, shall undergo the remaining period of imprisonment, if any. The life convict/petitioner shall utilize the leave only for the purpose for 3 / 5

which it has been granted and shall not indulge in any other activities involving law and order, etc.

8. With the above observations and directions, the Writ Petition is disposed of.
