The petitioners, who are arrayed as A1 to A5 and A7, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 294(b), 341 & 307 IPC, in Crime No.175 of 2016, on the file of the respondent police and hence, seek anticipatory bail.
2. The case of the prosecution is that on 13.03.2016 at about 8.30 p.m. the father of the defacto complainant was attacked by the second accused with Aruvaal, while the other accused caught hold him. The 6th accused attacked the sister of the defacto complainant and also, scolded in filthy language. 3.The learned counsel appearing for the petitioners would submit that both the accused and the defacto complainant are Pangalis (cousin brothers) and due to path way dispute, a false complaint against the accused was not taken on file by the respondent police. It is further submitted that according to the defacto complainant, the second accused has caused injury to the father of the defacto complainant and the other accused have no specific overact. It is further submitted that in respect of second accused viz., Sakthivel, he seeks permission of this Court to withdraw the petition.
4. The learned Government Advocate (Criminal side) appearing for the respondent submitted that the 6th accused was K.KALYANASUNDARAM,J
sms arrested and released on bail and the victim is still taking treatment as inpatient in Ganga Hospital, Coimbatore.
5. Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.
6.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Harur and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioners 1, 3 to 6 shall appear before the respondent police daily at 10.00 a.m., until further orders and in respect of the second petitioner, this criminal original petition is dismissed. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously. 7.The petitioners 1, 3 to 6 shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
